1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the Kinetic Edge Health website and services. By using our website, submitting an intake or assessment form, or becoming a patient, you agree to these Terms. If you do not agree, please do not use our website or services.

2. Who we are and what we provide

Kinetic Edge Health is a physician-led telehealth practice offering performance medicine, metabolic and hormonal health, and longevity-focused care. Our services are delivered remotely by licensed physicians to patients located in the states where those physicians hold a license.

3. Eligibility

To use our services you must be at least 18 years old and physically located in a state where our physicians are licensed (currently Ohio, Nebraska, Colorado, Florida, Arizona, and Illinois). We confirm availability in your state before proceeding. We may decline to provide services to anyone for whom care is not clinically appropriate or legally permitted.

4. No physician-patient relationship from the website alone

Using this website, reading our educational content, or submitting an intake form does not by itself create a physician-patient relationship and does not constitute medical advice. A physician-patient relationship is established when the formal Telehealth Informed Consent and Patient Agreement is executed during onboarding.

5. Informational content; not medical advice

Educational articles, protocol descriptions, and other content on this website are provided for general informational purposes only. They are not a substitute for individualized medical evaluation, diagnosis, or treatment. Always consult a qualified clinician about your specific situation. Individual results vary, and no specific outcome is promised or guaranteed.

6. Membership and fees

Certain services are provided through membership programs. Membership fees cover physician services, protocol design, and ongoing clinical oversight, and are billed as described at the time of enrollment. Laboratory testing, medications, and certain add-on services may be billed separately. Fees are subject to our Refund Policy. We may change our programs and pricing prospectively; changes will not affect a term you have already paid for.

7. Prescriptions and compounded medications

Any prescription is issued solely at the independent clinical judgment of a licensed physician, only when medically appropriate, and only after the required evaluation. Submitting an intake form or paying a membership fee does not guarantee that any medication will be prescribed.

Some medications we prescribe are compounded and prepared by a licensed compounding pharmacy. Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or quality. They are prescribed when a physician determines a compounded formulation is appropriate for you. Shipping of medications is governed by our Shipping Policy.

8. Telehealth

Our care is delivered via telehealth, including live audio or video consultation. By using our services you acknowledge the nature, benefits, and limitations of telehealth as described in our Telehealth Informed Consent. We do not prescribe based on an online questionnaire alone.

9. Acceptable use

You agree to provide accurate, complete, and current information; to use the website and services only for lawful purposes; and not to misuse, disrupt, copy, or attempt to gain unauthorized access to our systems or other users' information.

10. Intellectual property

The content, design, logos, and materials on this website are owned by Kinetic Edge Health or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

11. Third-party links and services

Our website may link to third-party sites and rely on third-party service providers. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their terms.

12. Disclaimers and limitation of liability

To the fullest extent permitted by law, the website and its informational content are provided "as is" without warranties of any kind. Nothing in these Terms limits any liability that cannot be limited under applicable law, including any obligations arising from the physician-patient relationship once established. Except as prohibited by law, Kinetic Edge Health will not be liable for indirect, incidental, or consequential damages arising from your use of the website.

13. Indemnification

You agree to indemnify and hold harmless Kinetic Edge Health and its personnel from claims arising out of your misuse of the website or violation of these Terms, except to the extent caused by our own negligence or misconduct.

14. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Care provided to patients located in other states is also subject to the laws and professional regulations of those states.

15. Changes to these terms

We may update these Terms from time to time. The effective date above reflects the most recent revision. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.
